Public Notice: NOTICE OF RECEIPT OF BALLOT TITLE FILED IN THE CITY OF ASHLAND

NOTICE IS HEREBY GIVEN that two ballot titles meeting the requirements of section 1(2)(d), Article IV of the Oregon Constitution (one subject) have been filed with the City Recorder.

The ballot title has been prepared by the City Attorney and is as follows:

CAPTION: Amending Ashland City Charter Article XIV-Chief of Police.

QUESTION: Shall the City of Ashland Charter be amended to allow the Chief of Police to designate a Sergeant-at-Arms?

SUMMARY:

A “Yes” vote for this measure amends the City Charter to allow the Chief of Police to designate another individual to act as the Sergeant-at-Arms at City Council meetings in the event the Chief of Police is unable to attend.

A “No” vote means the existing language in the City Charter remains that the Chief of Police shall attend all meetings of the City Council.

CAPTION: Amending the Ashland City Charter to appoint the City Recorder.

QUESTION: Shall the Ashland Charter be amended to remove the City Recorder as an elected position and allow appointment to position?

SUMMARY:

A “Yes” vote for this measure amends the City Charter to allow for the City of Ashland to hire an individual with appropriate training and skills to fill the City Recorder position.

A “No” vote for this measure maintains the existing language in the City Charter which outlines the sole qualifications for being elected City Recorder as residing within City limits and current registration to vote.

ANY ELECTOR DISSATISFIED WITH THE BALLOT TITLE may petition the Circuit Court seeking a different title and stating the reasons the title filed is insufficient, not concise or unfair.  Petition must name as respondent the City Attorney and must be filed no later than the 7th day after ballot title is filed with the City Recorder, March 6, 2024.  The court shall review the title and measure to be initiated or referred, hear arguments, if any, and certify to the city elections officer a title for the measure which meets the requirements of ORS 250.035.

AN ELECTOR FILING A PETITION shall notify the city elections officer in writing that the petition has been filed.  The notice shall be given NO LATER THAN 5 p.m. on the next business day following the day the petition is filed. ORS 250.296(2).
